Eternal Warranty

ECA helps win a legal case for the industry! In Town of Oyster Bay v. Lizza Industries the court of appeals sided with ECA’s position (after ECA submitted an amicus brief) and declined to revive a statute of limitations for work that was completed decades ago. If the case had come out the other way, it would have amounted to an eternal warranty of construction work completed.

Scaffold Study Shows Law Costing New Yorkers Billions and Decreasing Safety An important study, funded significantly by ECA, regarding New York State's Scaffold Law (Labor Law 240/241) was just released by researchers at the University at Albany and Cornell University. The study shows that not only does the law cost New York's economy billions of dollars, it also directly counters opponents' claims in that it causes more injuries rather than promote safety.
Overall, this study analyzed three areas: 1.) An Empirical Analysis of the Effects of New York's Labor Law 240 2.) Public Infrastructure Investment and Municipal Liability Costs in New York State 3.) Economic Impact Analysis of Labor Law 240 in New York State The conclusion each time was that the law does more harm than good. The study was sent to various media outlets already with a release outlining the critical findings. A full copy of the study can be found by clicking here, and you can read the summary release here. It is very important that state leaders hear from you regarding the need to reform this harmful law. If you have not done so already, contact your state legislator and demand reform today. You can do so right now, by clicking here.
